1. Description of Service

letsfunl.com provides an AI-powered marketing funnel builder. The platform processes user-uploaded data, text, images, and videos utilizing third-party artificial intelligence engines (including Google Gemini and Anthropic products) to generate marketing assets and structures.

2. Eligibility and Account Security

• Age Requirement: You must be at least 18 years of age to create an account or use our platform.
• Account Credentials: You are solely responsible for safeguarding your account login details. Any activity occurring under your account is your legal responsibility.
• Accuracy: You agree to provide true, accurate, and current information during registration and payment setups.

3. User Content & Intellectual Property Rights

• Ownership of Your Uploads: You retain all intellectual property rights over the text, images, and videos you upload to letsfunl.com.
• User Warranty: By uploading any content (images, videos, text), you warrant and represent that you own the rights to that content or have obtained all necessary licenses and permissions. You agree to indemnify us against any third-party copyright infringement claims resulting from your uploads.
• License to Process: You grant letsfunl.com a worldwide, non-exclusive, royalty-free license to host, transmit, and process your uploaded materials solely for the purpose of delivering the service (including transmitting data to our AI sub-processors).
• AI-Generated Output: Subject to your full compliance with these Terms, letsfunl.com assigns to you all its rights, title, and interest in the marketing funnels and assets generated for you by the service.
• AI Output Disclaimer: You acknowledge that the output is generated by artificial intelligence. We do not guarantee the uniqueness, accuracy, commercial viability, or trademark availability of the generated outputs. You are solely responsible for reviewing and vetting all AI-generated content before public or commercial deployment.

4. Billing, Subscriptions, and Refund Policy

• Payment Processing: All payments, subscriptions, and financial transactions are securely handled by our third-party payment processor, Stripe.
• Strict No-Refund Policy: Due to the nature of digital goods and the immediate, non-recoverable infrastructure and third-party API costs (Google Gemini and Anthropic) incurred during AI generation, all sales are final. We do not offer refunds, credits, or prorated billing for any subscriptions or service tiers once a payment has been processed.
• Cancellations: You may cancel your subscription at any time through your account dashboard. Your access will remain active until the end of your current paid billing cycle.

5. Fair Use and Acceptable Use Policy

To ensure system stability, security, and fair access for all users, you agree not to:

• Deploy automated scripts, bots, scrapers, or spiders to interact with the platform, scrape data, or mass-generate content.
• Abuse our API or platform infrastructure in a manner that creates an unreasonable load on our servers or artificially inflates computing costs.
• Upload content that is illegal, defamatory, harmful, or explicitly violates third-party intellectual property rights.
• Attempt to reverse-engineer, decompile, or bypass any usage limitations set on the platform.

6. Limitation of Liability and Disclaimers

• "As-Is" Service: The service is provided on an "as-is" and "as-available" basis. We disclaim all warranties, express or implied.
• No Business Guarantees: letsfunl.com does not guarantee any specific marketing outcomes, sales conversions, traffic spikes, or revenue improvements resulting from the use of our funnels.
• Liability Cap: To the maximum extent permitted by Portuguese and EU law, Andrei Kolokoltsev shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising out of your use of the platform.

7. Governing Law and Jurisdiction

These Terms and your use of letsfunl.com are governed by and construed in accordance with the laws of Portugal. Any legal action or dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Portugal.

8. YouTube and Google Ads

FUNL uses YouTube API Services and the Google Ads API so you can upload a video to a YouTube channel you choose and create an ad in a Google Ads account you administer. By using these features, you agree to be bound by the YouTube Terms of Service, in addition to these Terms.

You choose whether each uploaded video is public, private, or unlisted. The YouTube title is the ad headline you entered, and the description is the caption you entered. Google serves the ads you launch. Our Privacy Policy describes what Google and YouTube data FUNL accesses, how it is stored, and how to disconnect.
